The Power of One – Unlocking Opportunities in ASEAN through Law
A New Phase (and Face) of Law: Opportunities and Challenges in the ASEAN Economic Community (AEC)
This session will sketch the opportunities and challenges in the AEC. Areas that will be canvased include transactional and regulatory issues, dispute resolution, disruptive technology, competition and data protection. The possibility of AEC interfacing with other economic initiatives such as the Belt and Road Initiative will also be discussed, as well as how the AEC can draw on the lessons of other economic communities.
PARALLEL SESSION 1
Fair, Effective and Efficient Dispute Resolution to Facilitate the Success of the AEC
This parallel session will discuss possible dispute resolution mechanisms including ADR for cross-border transactions and multi-jurisdictional disputes. Issues discussed will also include service of process, and enforcement of judgments, arbitral awards and settlements.
PARALLEL SESSION 2
The Role of National Courts, if any, in Ensuring Compliance with ASEAN Obligations – A Mock Trial
Law as an Instrument to Facilitate the Success of the AEC
This plenary session will discuss the areas in which legal convergence could facilitate the success of the AEC. A specific area of convergence that will be discussed is cross-border insolvency.
Disruptive Technologies on Business Landscapes in ASEAN: Opportunities and Challenges
New and disruptive technologies are transforming business models both in domestic and international markets. How can the law and regulators facilitate and meet challenges of disruptive and new technologies to facilitate trade in the AEC? This session will focus on Fintech, and will feature a short demonstration by IBM on blockchain technology.
Power of ONE: AEC Financial Integration
This session will focus on AEC Financial Integration as harnessing the Power of One. Aspects of financial integration discussed will include cross-border listings, bond and fund-raising programmes in the AEC, the ASEAN Collective Investment Schemes Framework and common disclosure standards.
PARALLEL SESSION 1
Competition Law in the AEC
This session will discuss the various approaches to competition law in the AEC and how the ASEAN regimes can be harmonised to facilitate the development of the AEC.
PARALLEL SESSION 2
Rule of Law-Role in Attracting Trade and Investments in ASEAN – Free Trade Agreements and Bilateral Investment Agreements
This session will discuss how investors and businesses can leverage on FTA and BIT agreements amongst ASEAN member states as well as between ASEAN member states and other FTA partners (eg ASEAN-China Investment Agreement) to protect their investments. It will cover recent developments in investor-State disputes and lessons for ASEAN.
Cross-Border Obstacles in ASEAN and Solutions
This session will identify cross-border obstacles to trade and investments in ASEAN and the possible solutions from the perspectives of policy-makers, legislators, in-house counsel and practising lawyers.
Stock-taking and the Way Ahead
This final session will be an ‘armchair’ discussion to stock-take the recommendations and outcomes over the first 2 days of the conference, and to discuss the way ahead, including possible concrete steps that can be taken in the near future.
